Agreeing to these terms
These Terms of Use ("Terms") are an agreement between you and Sophia Sanders ("we", "us"), the publisher of the Becifo Active mobile application (the "App"). By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the App.
Your licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial golf record-keeping. The App, including its design, code, graphics and guides, belongs to us and is protected by intellectual-property laws. These Terms don't transfer any of those rights to you.
Your bag, courses and rounds
The club setups, hand-drawn holes, tee positions, shots, notes and exports you create ("Your Content") belong to you. Your Content is stored only on your device, so we can't access, recover or restore it. You're responsible for keeping your own backups.
If you draw or name a real golf course, you're responsible for making sure your use and any sharing of that drawing respects the course owner's rights. Exports you share are your responsibility once they leave the App.
Distances and statistics are estimates
The App calculates distances from where you tap on hole maps you drew yourself, and works out club averages from those figures. Results depend on how accurate your drawing, scale and taps are. They're approximations for personal practice and reflection.
Not an official tool. Distances and scores from Becifo Active are not certified measurements. Don't rely on them for handicap submission, competition rulings, wagering or any decision where accuracy is critical, unless the relevant rules body allows it.
On-course conduct and safety
Pay attention to your surroundings when using the App. Don't use your phone while swinging, while other players are hitting, or while driving a golf cart. Follow the course's rules, etiquette and any local restrictions on mobile devices. You're responsible for your own safety and for any harm caused by using your device during play.
Acceptable use
You agree not to:
- copy, modify, decompile, reverse-engineer or create derivative works from the App, except where the law expressly allows it;
- rent, sell, sublicense or redistribute the App;
- remove or alter any proprietary notices;
- use the App in any unlawful way, or to infringe anyone else's rights.
Purchases and app-store terms
The App is distributed through third-party stores such as Apple's App Store and Google Play. If the App or any feature is sold, the store processes the payment and its refund policies apply. We never see your payment details. The store's own terms also apply to your use of the App.
If you got the App from Apple's App Store, these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support and isn't responsible for any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't guarantee that the App will be error-free or uninterrupted, or that stored data will never be lost.
Some jurisdictions don't allow certain warranty exclusions, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, scores, wagers or enjoyment, arising from your use of the App. Our total liability for any claim is limited to the amount you paid for the App in the twelve months before the claim, or USD 10 if you paid nothing.
Nothing in these Terms limits liability that can't be limited under applicable law, including your statutory rights as a consumer.
Termination, changes, governing law and contact
Termination. You can stop using the App at any time by uninstalling it. Your licence ends automatically if you break these Terms.
Changes. We may update the App or these Terms. We'll post the updated Terms here with a new effective date. If you keep using the App after a change, you accept the updated Terms.
Governing law. These Terms are governed by the laws of the publisher's country of residence. This doesn't override any mandatory consumer protections in your own country. If any provision is found unenforceable, the rest remain in effect.
